Another paedophile denies rape charge

One Ebrima Badjie, a Senegalese, yesterday pleaded not guilty to a rape charge preferred against him before Justice Moses Richards of the Special Criminal Court in Banjul.

The accused was alleged to have had canal knowledge of a girl without her consent on July 29, 2009 at Kololi in the KSMD. The defence counsel, E.M. Sissoho made an application under Section 175 C sub-section C of the criminal procedure code urging the state to furnish the defence with all the evidence it has or intends to use in prosecuting his client.

Principal state counsel, S.H. Barkum in his response, opposed the application noting that the defence had misconstrued the said section. In his ruling, Justice Moses Richards disclosed that it is the international best practice that the prosecution must disclose its documents to the defence so as to enable the defence to prepare its case. Justice Richards then ordered the state to furnish the defence with the necessary documents.
